Investigation Finds Buffalo Officer Did Not Have Sirens On When He Struck Pedestrian

This story is an update on a story we reported on last week.

An officer who hit and killed a pedestrian was found to not be driving with emergency lights or sirens on when the incident happened. This information comes from the Buffalo Police, and the information was released last Thursday morning.

The victim was 64-year-old Susan Lotempio. Lotempio was taking a morning walk near Hertel Avenue and Tennyson Avenue when she was hit by the police car. She was pronounced dead at the scene.

The officer involved is Officer Daniel Ahearn. He is said to be cooperating with the investigators.

New York State Police are handling the accident reconstruction. The New York State Attorney General’s Office is investigating the death. They always do so when there is a civilian death related to a police officer.

According to the Attorney General’s office, “The Attorney General’s Special Investigations and Prosecutions Unit has opened an investigation into this morning’s incident, pursuant to the Attorney General’s authority under Executive Order No. 147. We’re committed to conducting an independent, comprehensive, and fair investigation.”

Did you lose a loved one in a pedestrian accident? Was the accident caused by the negligent or careless actions of another person or group of people? If so, there could be legal actions you can take.
