Bath Beach, NY (October 28, 2026) – At about 6:40 p.m. on October 28, a 30-year-old woman was struck and killed by a city Sanitation truck in Brooklyn, according to police. She was crossing from the southwest corner to the southeast corner of Bay Parkway at Crospey Avenue, authorities said.
Police said the Sanitation driver struck her during a right turn. She suffered severe trauma and was taken to NYU Langone Hospital, where she was pronounced dead.
The 41-year-old truck driver remained at the scene. No arrests have been made, and the NYPD’s Highway District Collision Investigation Squad is investigating.
This is a developing story. Details may change as the investigation continues.
When a City Truck Is Involved in a Fatal Pedestrian Crash in Brooklyn
NYC DOT recorded 63 traffic deaths in Brooklyn in 2025, down from 69 in 2024. When a city vehicle is part of a fatal crash, the claim follows different rules than a crash between private drivers.
New York’s General Municipal Law § 50-e requires a notice of claim to reach the city within 90 days. In a death case, those 90 days begin when a representative of the estate is appointed, so opening the estate early protects the claim. After a death, the estate can bring a wrongful death claim for the family’s losses and a survival claim for what the victim endured.
- First steps: Request the crash report and the squad’s contact, keep records of medical and funeral costs, and preserve camera footage from nearby businesses and buses.
- Who may be liable: The City of New York and the Sanitation driver are the starting point, and the investigation will show who else may share responsibility.
- Deadlines: Counting from the crash, notice of claim is due by January 26, 2027, and a suit against the city by January 26, 2028. Any other wrongful death suit has until October 28, 2028 (EPTL § 5-4.1). If fault is disputed, CPLR § 1411(b) bars recovery when the injured person’s fault equals or exceeds the combined fault of the defendants.
