New York's Statute of Limitations for Vehicle Accident Claims

New York law sets strict deadlines for filing car accident lawsuits. If you miss these deadlines, you may lose your right to recover compensation, no matter how strong your case is.

Filing Deadlines:

  • Personal injury claims: You have 3 years from the date of the accident (NY CPLR §214(5)).
  • Wrongful death claims: You have 2 years from the date of death, not the accident date if death occurs later (NY EPTL §5-4.1).
  • When the clock starts: The time limit begins on the date of the accident. It does not depend on when you discover injuries, hire a lawyer, or receive an insurance denial.

Limited Exceptions:

  • Minors: Claims are tolled until the victim turns 18
