Bronx, NY – 75-Year-Old Pedestrian Critically Injured in Highbridge Crash, SUV Driver Arrested

75-Year-Old Pedestrian Critically Injured

Bronx, NY (September 29, 2026) – A 75-year-old man was in critical condition after an SUV struck him in Highbridge, and the driver was arrested, police said. The crash happened at 10:10 a.m. on Jerome Ave. near E. 164th St.

According to police, the man was crossing Jerome Ave. when the driver of a white Fisker Ocean SUV struck him during a right turn off E. 164th St. Police said the man was in the crosswalk and had the right of way.

The man suffered severe head trauma. Medics rushed him to Lincoln Hospital in critical condition.

The driver, 34, a Manhattan resident, was arrested and charged with failure to yield to a pedestrian causing injury and failure to use due care causing serious injury. His arraignment was pending late on September 29.

This is a developing story. Details may change as the investigation continues.

Pedestrian Accidents in the Bronx, NY

When a driver turns into a pedestrian in a crosswalk, several questions matter at once. Liability, evidence, and insurance all move quickly.

  • Who may be liable: the driver, the vehicle’s owner, and an employer if the driver was working at the time
  • What investigators examine: intersection and business camera footage, the SUV’s onboard data, and witness statements
  • What coverage may apply: the driver’s auto liability policy, plus no-fault benefits for medical bills and lost earnings regardless of fault

A criminal case runs separately from a civil claim. Charges and their outcome do not decide what an injured person may recover.

No-fault benefits generally require an application within 30 days of the crash (11 NYCRR 65-1.1). Here, that date is October 29, 2026.

Under New York law, you generally have three years from the date of the crash to file a personal injury claim (CPLR § 214). That puts the deadline at September 29, 2029. If an injured person later dies, a wrongful death claim generally must be filed within two years of the date of death (EPTL § 5-4.1).

Fault is still weighed. Police said the man was in the crosswalk with the right of way. Even so, New York can bar recovery in motor vehicle cases when a claimant’s fault equals or exceeds the defendants’ combined fault (CPLR § 1411(b)).
