Bronx, NY (November 1, 2026) – Police said a 43-year-old man was critically hurt after he was struck by a northbound Bx41 MTA bus on Webster Ave. near E. 171st St. at about 2 a.m. on November 1.
Medics took the man to St. Barnabas Hospital in critical condition. The 37-year-old bus driver stayed at the scene and faced no immediate charges, according to police.

Bus Crash Claims Against the MTA in New York: The 90-Day Notice Rule
The NYPD’s September 2026 collision report counted 117 pedestrians injured and 1 killed in the Bronx that month. When a bus run by the MTA is involved, the claim is against a public authority, and the rules differ from an ordinary car crash.
A bus operator owes the people it shares the road with a duty of care, and New York weighs each side’s share of fault. Serious injuries can mean long-term medical needs, so the full cost of a claim may not be clear for months.
- First steps: Request the crash report number, record the route and bus number, keep every hospital bill, and ask a lawyer to demand that bus and nearby camera footage be preserved before it is overwritten.
- Who may be liable: The transit authority that operates the bus and its driver may be responsible, along with any other party the investigation identifies.
- Deadline: A notice of claim is due within 90 days, which is January 30, 2027 (Gen. Mun. Law § 50-e; Pub. Auth. Law § 1212). The deadline to sue is shorter than the usual three years. If fault is shared, recovery is barred only when the claimant’s fault equals or exceeds the combined fault of the defendants (CPLR § 1411(b)).
