Bronx, NY (October 3, 2026) – A 24-year-old man was killed early on October 3 after crashing a two-wheeled vehicle on the northbound Major Deegan Expressway in the Bronx, according to police.
The crash happened around 4:20 a.m. near Exit 5 in the Highbridge section. Investigators said the rider was traveling northbound when he failed to navigate the roadway and struck a guardrail, according to police.
The impact ejected the rider from the vehicle. He was pronounced dead at the scene.
The NYPD’s Collision Investigation Squad is investigating the crash. No arrests have been made, and the investigation remains ongoing. The victim’s identity has not been released pending family notification.
This is a developing story. Details may change as the investigation continues.
What Investigators Examine After a Single-Vehicle Crash in the Bronx
A single-vehicle crash does not mean there is no claim. When a rider strikes a guardrail on a state expressway and the investigation is still open, attorneys and investigators look at a set of factors that go beyond the rider’s own actions.
The condition of the road surface, guardrail placement, signage, lane markings, and lighting all fall under the responsibility of the agency that maintains the roadway. The Major Deegan Expressway is Interstate 87, maintained by the New York State Department of Transportation. If the guardrail, road surface, or sight lines contributed to the crash, the maintaining agency may bear responsibility under a dangerous-condition theory. A claim like that requires proof that the condition existed, the agency knew or should have known about it, and had time to fix or warn but did neither. Complaint records, 311 history, inspection logs, and prior crash data at the same location are the evidence that builds or breaks that case.
A passenger in the vehicle can also file a claim against the rider’s own insurance policy, and mechanical failure in tires, brakes, or steering can shift liability to a manufacturer or maintenance provider.
- Government notice deadline: If a state agency is responsible, the Court of Claims Act requires a notice of intention or claim within 90 days. This crash occurred on October 3, 2026, putting that deadline at January 1, 2027. Missing that notice usually ends the claim before it starts.
- Filing deadline: Under New York law, you generally have three years from the crash to file a personal injury claim (CPLR § 214). That puts the deadline at October 3, 2029. A wrongful death claim must be filed within two years of the date of death (EPTL § 5-4.1), which is October 3, 2028.
- Comparative fault: For motor vehicle injury claims, New York’s modified comparative fault rule (CPLR § 1411(b), effective May 2026) bars recovery when the claimant’s fault equals or exceeds the defendants’ combined fault.
- What the family can do: After a fatal crash, New York’s wrongful death statute lets the personal representative of the estate file for the family’s financial losses, including funeral costs, lost financial support, and loss of parental guidance. A separate survival claim covers the pain and suffering the victim experienced before death.

When a fatal crash involves a guardrail on a state expressway, the first priority is preserving the evidence that disappears. Dashcam data, traffic camera footage from the Major Deegan, road-surface photos, and the guardrail itself all have limited preservation windows. Our Bronx motorcycle accident attorney team sends preservation letters early and retains investigators who can reconstruct the crash before the physical scene changes.
The firm has recovered more than $900 million for injured New York clients, including a $69,225,000 auto accident jury verdict that remains one of the largest in state history.
