Melba Jordan, 45, Dies After Dump Truck Strikes

Crown Heights, NY (July 21, 2026) – Melba Jordan, 45, of Boerum Hill, died after a dump truck struck her while she was riding an electric stand-up scooter on Franklin Avenue, according to police. The incident occurred just after 11 a.m.

A preliminary investigation by the NYPD Highway District’s Collision Investigation Squad determined that Jordan was traveling northbound on Franklin Avenue when she collided with a 2007 Peterbilt dump truck, police said. The truck, operated by a 68-year-old man, was traveling southbound on Franklin and making a right turn onto Pacific Street at the time of the crash.

Emergency Medical Services transported Jordan to NYC Health + Hospitals/Kings County in critical condition. She was later pronounced deceased at the hospital.

The truck driver remained at the scene. No charges have been filed. Detectives from the Collision Investigation Squad are canvassing for witnesses and searching for surveillance footage from the area that may have captured the moments before the crash.

Jordan’s death marked the second fatal crash along Franklin Avenue in less than a week, according to police.

Losing someone at a city intersection to a commercial truck leaves a family with questions that no one should have to chase down alone. A civil claim runs separately from the criminal investigation, and the two timelines do not wait for each other.

What Families Should Know After a Fatal Dump Truck Crash in Brooklyn

When a commercial vehicle kills someone in New York City, the investigation and any civil claim both look beyond the individual driver. A 2007 Peterbilt dump truck is a commercial vehicle, and multiple parties can carry responsibility for a fatal crash.

Key questions for the investigation and any wrongful death claim:

  • Who owns the dump truck, and what company operated it on July 21, 2026
  • Whether the truck driver held a valid commercial driver’s license at the time of the crash
  • Whether the truck passed required safety and equipment inspections
  • Whether the right-turn maneuver violated Jordan’s right of way on Franklin Avenue
  • What intersection surveillance or nearby cameras captured in the seconds before impact

New York follows a pure comparative fault standard, meaning a family may still pursue a claim even if questions are raised about the victim’s path of travel. A determination that the other party bears any share of fault opens the door to recovery.

A wrongful death claim can cover the loss of financial support, funeral expenses, and the conscious pain and suffering Jordan experienced before she died.

Under New York’s wrongful death statute (EPTL § 5-4.1), a family has two years from the date of death to file a wrongful death claim. Jordan died on July 21, 2026, making the filing deadline July 21, 2028.

Commercial truck black box data, driver dispatch logs, and vehicle inspection records can be overwritten or destroyed in weeks. Acting quickly protects access to that evidence before it is gone.

This is a developing story. Details may change as the investigation continues.
