Next Steps After a Police Vehicle Collision on Staten Island
NYC DOT reported 13 traffic deaths on Staten Island in 2025, up from 12 in 2024. Because this crash involved an NYPD vehicle, the City of New York may be a party to any claim, and that brings short deadlines.
- Get checked. Anyone in the crash should see a doctor within 72 hours, since whiplash, concussion and internal injuries can surface late.
- Preserve the evidence. Photograph the vehicles and the intersection, ask for the crash report, and ask in writing that video and vehicle data be kept.
- Notify your insurer. New York requires written notice to the no-fault insurer within 30 days, which is November 20, 2026. Do not give a recorded statement to another insurer.
- Send the notice of claim. If the city may be responsible, New York requires notice within 90 days (Gen. Mun. Law § 50-e), by January 19, 2027. Whether an officer was responding to an emergency can change the legal standard (Vehicle and Traffic Law § 1104).
- Know the filing deadlines. A lawsuit against the city generally must be filed within one year and 90 days (Gen. Mun. Law § 50-i), by January 19, 2028. Claims against private parties have three years (CPLR § 214), until October 21, 2029.
Fault has not been determined. CPLR § 1411(b) bars recovery only when the injured person’s fault exceeds the combined fault of the defendants.
