Flushing, NY (October 11, 2026) – Just after 8:30 a.m. on October 11, a pickup truck struck a child in a stroller and the child’s nanny, police said. The crash happened at Murray Street and 32nd Avenue in Flushing.
Police said a 57-year-old man was driving the pickup truck northbound on Murray Street when he went through the intersection. He struck the child, who was sitting in the stroller, and the 69-year-old nanny who was pushing it. Police said both were in the crosswalk.
The child was critically injured and taken to a hospital, where he later died, police said. His age has not been released. The nanny was also taken to a hospital and was last reported to be in stable condition.
Police said the driver stayed at the scene and was taken into custody. Police said he was charged with vehicular manslaughter, reckless driving, and driving with ability impaired by drugs or alcohol. He also faces charges of failure to yield to a pedestrian and failure to stop at a stop sign.
This is a developing story. Details may change as the investigation continues.
Your Legal Questions After a Pedestrian Crash in Flushing, NY
Who can be held responsible when a driver hits people in a crosswalk?
The driver, and the pickup truck’s owner if someone else holds title. If the truck was being used for work, an employer may share responsibility.
Can a family file a claim after a child dies in a crash?
Yes. A wrongful death claim covers financial losses such as funeral costs, and a separate survival claim covers pain the child felt before death. The estate’s court-appointed representative files both.
Can the injured caregiver file a separate claim?
Yes. The caregiver can bring an injury claim within three years of the crash, which puts the deadline at October 11, 2029 (CPLR § 214). Workers’ compensation may also apply if the caregiver was working.
How long does the family have to file a wrongful death claim?
Two years from the date of death (EPTL § 5-4.1). If the child died on October 11, 2026, the deadline is October 11, 2028.
Does the criminal case control the civil claim, and can fault still be shared?
No. The civil claim runs on its own track, whatever happens in criminal court. If fault is argued, New York bars recovery only when a pedestrian’s fault equals or exceeds the defendants’ combined fault (CPLR § 1411(b)).
