Key Legal Points After a Car Crash in Greenpoint, NY
The New York City Department of Transportation reported 63 traffic deaths in Brooklyn in 2025, down from 69 in 2024. Anyone hurt in a crash like this one faces several short deadlines, and the first one is only weeks away.
- First steps: Get checked by a doctor the same day even without pain, ask for the police crash report number, and photograph the vehicles, the barrier and the fence before anything is moved or repaired.
- Who may be liable: Investigators have not said what caused the crash, so responsibility may rest with any driver whose conduct contributed to it, or with the owner of a vehicle driven with permission.
- If fault is shared: For motor vehicle injury claims, CPLR § 1411(b), effective May 26, 2026, bars recovery only when the injured person’s fault is greater than the combined fault of the parties being sued. Damages are otherwise reduced by that person’s share.
- Insurance that may apply: No-fault coverage through your own auto policy pays medical bills first, whoever caused the crash. New York requires written notice to the no-fault insurer within 30 days, which for an October 18 crash is November 17, 2026.
- Deadline: Under CPLR § 214, the general deadline to file a personal injury lawsuit is October 18, 2029.
