Robert Krumm, 24, of Holtsville Seriously Hurt

Holbrook, NY (August 4, 2026) – A man driving a Tesla was arrested on drug-impairment charges after crashing into a motorcyclist on Nicolls Road in Holbrook late on the night of August 4, leaving the rider seriously injured, according to Suffolk County police.

Robert Krumm, 24, of Holtsville, was riding a 2017 Suzuki motorcycle southbound on Nicolls Road when the collision occurred around 11 p.m. between Greenbelt Parkway and Route 27. Suffolk County police say Krumm was transported to Stony Brook University Hospital for treatment of serious injuries.

Bertie Simeon, 37, of Huntington Station, was operating the Tesla, also traveling southbound, when his vehicle struck Krumm’s motorcycle, according to police. Suffolk County police say Simeon was high on drugs at the time of the crash and was taken into custody. He faces a charge of DWAI/drugs and is scheduled to be arraigned at First District Court in Central Islip on August 5, 2026.

Detectives are asking anyone with information about the collision to call the Suffolk County Police Department Fifth Squad at 631-854-8552.

This is a developing story. Details may change as the investigation continues.

Drug-Impaired Driving and Motorcycle Accident Claims in New York

A DWAI/drugs arrest does not need to produce a criminal conviction before an injured motorcyclist can pursue a civil claim. The two tracks run parallel and independent of each other.

  • Who may be held liable: the driver accused of operating while impaired by drugs bears primary responsibility for any injuries his vehicle caused
  • What attorneys and investigators look at: toxicology results, the speed and lane positions of both vehicles at the time of impact, dashcam footage, traffic or surveillance camera records, and witness statements
  • Evidence from the crash scene and from Simeon’s arrest, including any chemical test results, may be used in a civil proceeding
  • New York follows a pure comparative fault standard, meaning an injured rider can recover compensation even if investigators find some share of fault on the motorcyclist’s side

Under New York law, an injured person generally has three years from the date of the crash to file a personal injury claim (CPLR ยง 214). This crash occurred on August 4, 2026, putting the filing deadline at August 4, 2029. That window may feel distant, but physical evidence disappears quickly. Crash data, dashcam footage, and vehicle inspection records are best preserved before they are overwritten or discarded.
