Staten Island Car Crash Claims in New York: Five Common Questions

The NYPD’s September 2026 collision report counted 111 motorists injured and 1 killed in Staten Island crashes that month. Anyone hurt in a crash like this one has legal options.

What should I do first after a crash on the expressway?

See a doctor the same day, even without pain, since symptoms can appear later. Ask police for the crash report number and photograph the vehicles and the scene.

Who can be held responsible for a car crash in New York?

The driver and the vehicle’s owner, and sometimes others, depending on what investigators find about the road, the vehicle, or another driver.

Can I still recover if police have not said who caused the crash?

Possibly. Fault is decided from the evidence, and New York’s motor vehicle rule bars recovery only when your fault equals or exceeds the defendants’ combined fault (CPLR § 1411(b)).

What if a government agency played a part?

A notice of claim against a city or state agency is due within 90 days, by January 31, 2027 (Gen. Mun. Law § 50-e; Ct. Cl. Act § 10).

How long do I have to file a claim?

Three years from the crash, which is November 2, 2029 (CPLR § 214). No-fault notice is due sooner, by December 2, 2026 (11 NYCRR 65-1.1).
